1.  MAXIMUM OCCUPANCY
The unit sleeps 10.  However, due to our current Condo Rental Rules, the maximum number of guests allowed in the property at any time is eight (8) persons.  Sleeping arrangement consist of two king beds that sleeps 4, two bunkbeds that sleeps 4, and a convertible futton that sleeps 2.  However, each accomodation cannot exceed the number of guests specified in each Rental Agreement.  Unless written or special arrangements are made in advance, any guest not complying with this maximum number will be asked to leave without refund for any advance payment, deposit and/or rental money.
 
2.  MINIMUM STAY (3 nights)
We require a 3 Night minimum stay per accommodation, longer stays are required during holidays.  During peak rental periods, the minimum stay is 7 nights per accomodation.
 
3.  NO SPRING BREAKERS
Our beach house is for Family Rentals only.  We do not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent.  We do NOT rent to Spring Breakers.
 
4.  CHECK-IN / CHECK-OUT TIME  (3 pm / 10 am)
Check-in is after 3:00pm and check-out is 10:00am.  NO early Check-ins and no late Check-outs without prior approval.
 
5.  AVAILABILITY & RATE CHANGES
Until Reservations are confirmed, rates and availability are subject to change without notice.
 
6.  RENTAL CONFIRMATION
Reservations are confirmed upon receipt of an advance deposit.  The first payment equal to 25% of the rental fee along with a signed rental agreement will be required to hold (confirm) the requested reservation.  The deposit must be received within 7 days after making the reservation or the space will be released.  No warranty is stated or implied by our acceptance of your advance deposit.  By sending us your advance deposit, you demonstrate your commitment to honor your reservation.  The advance payment will be applied toward the rental fees only.  It is not a Security/Damage Deposit.
 
7.  REFUNDABLE SECURITY/DAMAGE DEPOSIT

A refundable security/damage deposit of $1000 is required.  This deposit is due no later than 2 weeks before arrival date.  Refunds on your deposit will be mailed by check within 2 weeks of your departure.  Please make sure your mailing address is correct.  The deposit is NOT applied toward rent; however, it is fully refundable provided the following provisions are met:
A) No damage is done to unit or its contents, beyond normal wear and tear.
B) No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay. C) All debris, rubbish and discards are placed in dumpster, and soiled dishes are placed in the dishwasher and cleaned. 
D) All keys  are left on the kitchen table and unit is left locked.
E) No towels or linens are lost or damaged.
F) NO Early check-in or late check-out.
G) The renter is not evicted by the owner (or representative of the owner) or the local law enforcement.
 
8.  PAYMENTS
To confirm your reservation, the advance payment of 25% of rental fee is due no later than 7 days after booking.  The remaining 75% of the rental fee is due 6 weeks prior to arrival (8 weeks for monthly rental).  If full payment is not received, your reservation will be subject to cancellation without any refund.  The Security Deposit is due 2 weeks prior to arrival.  Please make all payments in the form of traveler’s check, bank money orders, cashiers check or personal checks.  For last minute reservation, made less than 6 weeks before arrival, full payment for the rental fee must be received no later than 7 days after booking.  For reservations made less than 3 weeks before arrival, full payment for both the rental fee and the security deposit must be received within 1 week after booking.
 
9.  INCLUSIVE FEES
The following items are included in the rental fee:
A) One-time linen-towel setup per accommodation on day of arrival.
B) Amenities (Cable TV, High Speed Internet, Local Telephone Calls).
C) Domestic Long Distance Calls are free.  Guests are responsible for International Long Distance phone charges.
D) One-time housekeeping/cleaning service to prepare the unit for the next guest.
 
10.  DAILY MAID SERVICE
Daily Maid service for “light” housekeeping is available for an additional fee of $20 per day.  Please let us know in advance if you would like to have this service.  This service, however, is subject to availability of our housekeeper.  Our housekeeper will normally spend 30 minutes to a maximum of one hour and will typically perform the following basic cleaning chores:
A) Light sweeping and/or mopping of the floors.
B) Bedrooms - Light clean-up, make-up main beds, clean bathrooms, rinse showers/tubs.
C) Kitchen - Light clean-up, place trash in dumpster, place dishes in the dishwasher.
NOTE: The maid will not change linens, do the laundry, nor provide fresh towels and linens.  Fresh towels and linens are available at an additional fee of $20 per day.  Please note that we do not permit towels or linens to be taken outside the property.
 
11.  CANCELLATIONS
Cancellation within the allowable cancellation period will incur no penalty.  Any cancellation or early departure beyond the allowable cancellation period does not warrant any refund for advance payment and/or rental payment.  Please notify us immediately of cancellations so that we may re-rent the property.  If we are able to re-rent the property and have to reduce the rent amount, you will be responsible for the difference.  If we are unable to re-rent the unit, the money you paid in advance for rental fee is non-refundable.
A)  Daily/Weekly Rentals – A six (6) week notice is required for cancellation.  Cancellations that are made more than 6 weeks prior to the arrival date incur no penalty.  Cancellation or changes that result in a shortened stay, that are made less than 6 weeks of arrival date, forfeit the full refund for advance payment and damage/reservation deposit. 
B)  Monthly Rentals – A ninety (90) day notice is required for cancellation.  Cancellations that are made more than 90 days prior to the arrival date incur no penalty.  Cancellation or changes that result in a shortened stay, that are made less than 90 days of arrival date, forfeit the full refund for advance payment and damage/reservation.
 
12.  UN-AVAILABILITY
In the event that a reservation is made, and the property will not be available because of damage to the property, because the property has been sold, or for other reasons beyond our control, we will notify you by phone or email.  You will receive a complete refund of your advance payment.  At your request, we will also do our best to help you find another rental property.
 
13.  PARKING
Each condo unit is allowed two parking space.  For additional parking, there are some public parking spaces available on the street.  Our property does not have an oversized parking space for large RV’s, trailers, or boats.  Please contact us if you have any special parking needs
 
14.  KEY/LOCK
Our property is equipped with a WebKey electronic lock system.  A time-sensitive access code will be provided to you when  final payment for the security deposit is received.  Upon arrival, you have the option to program your own personal code.  Your code and that of any other renters is only valid for the days of the rental period.  At the end of your rental period, the code automatically expires.  This provides a high level of security for you, your family, and your belongings.
 
15.  NO SMOKING

This is a non-smoking rental property. Smoking is not permitted anywhere inside the property.  Should anyone in your group smoke, please have them do so outside on patio, porch, or balcony.  There will be an additional fee of $500 for cleaning and damages for those guests found to have smoked in the property.
 
16.  NO PETS
Due to the Condo Rental Regulations, pets are not permitted in the property.  Should we discover a pet in the accommodations, you will be charged a fee for cleaning, pest control, and an additional day’s rent.  In addition, you will need to board your pet at a local kennel or leave the accommodations without any refund of your advance rental fee payment.
 
17.  CONDITION OF PROPERTY
We have tried to describe the property and its furnishing as accurately as possible.  However, sometimes we may remodel or redecorate the property after the information has been provided.  The condo was completed in June 2006, so it’s practically brand new.  We will make every effort to keep our property and its equipment in good working order, and to make repairs as soon as possible when we are notified of a problem.  No refund or rate adjustment will be made for mechanical failures, such as air conditioning, television or appliances.
 
18.  HURRICANE OR STORM POLICY
No refunds will be given unless The National Weather Service orders mandatory evacuation in South Padre Island area due to a Tropical Storm/Hurricane.  This policy does not apply to monthly rentals.  The day that the National Weather Service orders a mandatory evacuation, we will refund:
A) Any unused portion of rent from a guest currently registered,
B) Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted; and
C) Any advance rents collected for a reservation that is scheduled to arrive during the “Hurricane Warning” period.
 
19.  LOST & FOUND
Although we cannot be held responsible for items left behind, we will make every effort to locate and return forgotten items to you. We will not ship any items unless arrangements are made to ship the items at your expense.
 
20.  SUGGESTIONS ON WHAT TO BRING
You will need to bring your own soap & paper products, and food & condiments.  If you plan to do any specialty cooking, you will need to bring your own bake ware, casserole dishes, food processor, etc.  We suggest you bring beach towels.  We do not permit towels or linens to be taken from the property.
 
21.  WRITTEN EXCEPTIONS
Any exceptions to the above mentioned policies must be approved in writing in advance.
 
22.  FALSIFIED RESERVATION
Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and rental money, and the party will not be permitted to check-in.
